The purpose of this study is to re-assess Karl Barth's use of the Kierkegaardian “infinite qualitative distinction between God and man”. It juxtaposes Kierkegaard's qualitative dialectic and Karl Barth's own complementary dialectic respectively. Then it compares and contrasts their similarities and dissimilarities in various contexts that would lead us to a more balanced assessment of Barth's use of Kierkegaardian diastasis and a better understanding of the ultimate purpose for holding fast to the bipolar but relational God-man unity of the Incarnation. In contrast to Hegelian synthesis, the article contends that the dynamics of the dialectics of Kierkegaard and Barth should be understood in the manner of a complementary synthesis of two opposites. Patientenmobilität und grenzüberschreitende Gesundheitsversorgung sind alltägliche Phänomene in der Europäischen Union (EU). Im Jahr 2011 hat die EU eine Richtlinie erlassen, um in diesem Kontext Rechtssicherheit herzustellen. Bisher gibt es keine umfassenden systematischen Studien über ethische Aspekte grenzübergreifender Gesundheitsversorgung. In dieser Arbeit werden die rechtlichen Entwicklungen der grenzübergreifenden Gesundheitsversorgung dargestellt und die in der Literatur vereinzelt erwähnten ethisch relevanten Aspekte heuristisch und auf Patiententypologien aufbauend systematisch inventarisiert und diskutiert. Es zeigt sich, dass die Möglichkeit der Patientenmobilität und die damit vor (...) allem verbundenen Finanzierungsregelungen die Autonomie einiger Patienten sicherlich verbessern kann. Allerdings können wohl nicht alle Patienten Versorgungsverbesserungen erwarten. Im Gegenteil können sogar negative Konsequenzen für einige Patienten folgen, was vor allem aus gerechtigkeitstheoretischen Überlegungen kritisch zu sehen ist. (shrink)

Es wurde für die These argumentiert, dass der Begriff der Würde in der Medizinethik nutzlos sei und in den Fällen, in denen er verständlich verwendet wird, nichts anderes meint als den Respekt vor der Autonomie von Personen. In diesem Aufsatz soll gezeigt werden, dass diese These falsch ist. Es wird ein Begriff von Würde vorgestellt, der sich nicht auf den Begriff des Respekts vor der Autonomie von Personen reduzieren lässt. Anhand der Diskussion um ein Sterben in Würde soll auch deutlich (...) werden, dass auf den Begriff der Würde auch in der Medizinethik nicht verzichtet werden kann. (shrink)

Neben grundsätzlichen konzeptionellen Fragen der sog. Individualisierten Medizin (IM), prägen ethische Bedenken und Fragen die aktuellen Debatten um die IM. Allerdings ist bislang noch nicht geklärt, in welchem methodischen Rahmen diese Fragen verortet werden können. Für die Entwicklung eines solchen Rahmens wird das Modell der First- und Second-Wave-Bioethics diskutiert und an zwei konkreten Herausforderungen – 1) dem Verhältnis der IM zur evidenz-basierten Medizin und 2) am Konzept der genetischen Risikoperson – aufgezeigt. To promote inclusive development and comply with equal opportunity legislation, South African companies often fast-track careers of high-potential previously disadvantaged individuals. Organisations typically do not sufficiently support transitioning leaders, possibly acting unethically. The rate of failure is high with devastating effects for the individual and their organisation. The novel, empirically researched Transformative Transition Coaching framework, helps facilitate deep and lasting changes in meaning perspectives of transitioning leaders through coaching. The essays explore the justice of current environmental practices, asking such questions as whether cost-benefit analysis is an appropriate analytic technique and whether there are alternate routes to sustainable development in the South.

In October 1775, David Hume wrote to his printer William Strahan, requesting that an ‘Advertisement’ should be attached to remaining copies of the second volume of his Essays and Treatises on Several Subjects. This volume contained his two Enquiries, the Dissertation on the Passions, and The Natural History of Religion, and the Advertisement states that these works should ‘alone be regarded as containing his philosophical sentiments and principles’ (E 2). In the covering letter, Hume comments that this ‘is a compleat (...) Answer to Dr Reid and to that bigotted silly Fellow, Beattie.’ (HL ii. 301). My aim here is to try to throw light on what Hume might have meant by this comment, and to assess to what extent it might have been justified. (shrink)

Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer (...) class='Hi'>Peter van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. Like the Copernican revolution, which de-centered humanity in the cosmos, the intelligence revolution is dissolving once-foundational certainties and opening new realms of opportunity. The results are almost sure to be mixed. Smart cities will be more efficient and more livable; smart health care (...) can potentially reach and benefit the half of humanity that now lacks even basic health services. Yet, smart services and the algorithmic tailoring of individual experience have the potential to first supplement and eventually supplant intelligent human practices, rendering human intelligence superfluous. Focusing in particular on the karmic dimensions of these transformations, the talk will consider who we need to be present as in order to resist the allure of digital sirens and direct the intelligence revolution toward a truly equitable and ethical re-centering of the human. Physician Assisted Suicide is illegal in Rhode Island. The Lila Manfield Sapinsley Compassionate Care Act would make PAS legal if passed into law and it was reintroduced in 2021 in the General Assembly of Rhode Island. This letter by SCSS Board of Directors member Dr. Peter Colosi of Salve Regina College in Rhode Island was written in response to that and was published in The Newport Daily News in Newport, Rhode Island, on March 18, 2021, and is reprinted in (...) the Review with permission. This paper is the eulogy which was delivered by Dr. Peter A. Redpath (Senior Fellow, Center for the Study of The Great Ideas) on the occasion of the funeral of Ronald “Max” Weismann (1936–2017) on 06 May 2017 at St. John Chrysostom Church, Chicago, USA.

This collection of essays, inspired by the author's experience teaching ethics to Marine and Navy chaplains during the Iraq War, examines the moral and psychological dilemmas posed by war. The first section deals directly with Dr Peter A. French's teaching experience and the specific challenges posed by teaching applied and theoretical ethics to men and women wrestling with the immediate and personal moral conflicts occasioned by the dissonance of their duties as military officers with their religious convictions. The following (...) chapters grew out of philosophical discussions with these chaplains regarding specific ethical issues surrounding the Iraq War, including the nature of moral evil, forgiveness, mercy, retributive punishment, honour, torture, responsibility and just war theory. This book represents a unique viewpoint on the philosophical problems of war, illuminating the devastating toll combat experiences take on both an individual's sense of identity and a society's professed moral code. Over the last century, the world's urban population increased from 224 million to over 3.5 billion, and advances in manufacturing, transportation, and communication technologies brought virtually limitless lifestyle and identity options, as well as the greatest inequalities of wealth, risk, and opportunity in history. Yet, as momentous as these changes are, they are dwarfed by the fact that human activity is now affecting planetary processes like climate. Justice concerns about future generations are no longer academic curiosities; they are global ethical (...) imperatives. This talk by Dr. Peter D. Hershock builds on recent efforts to craft an ethics of global justice around the "social emotion" of compassion, making use of Buddhist conceptual resources to de-link justice from fictions of equality and conceive it, instead, as a dynamic function of relationally-achieved equity and diversity. This study, unique of its kind, asks how slavery was viewed by the leading spokesmen of Greece and Rome. There was no movement for abolition in these societies, nor a vigorous debate, such as occurred in antebellum America, but this does not imply that slavery was accepted without question. Dr Garnsey draws on a wide range of sources, pagan, Jewish and Christian, over ten centuries, to challenge the common assumption of passive acquiescence in slavery, and the associated view that, Aristotle (...) apart, there was no systematic thought on slavery. The work contains both a typology of attitudes to slavery ranging from critiques to justifications, and paired case-studies of leading theorists of slavery, Aristotle and the Stoics, Philo and Paul, Ambrose and Augustine. In this remarkably clear and original study of the Tractatus Peter Carruthers has two principal aims. He seeks to make sense of Wittgenstein's metaphysical doctrines, showing how powerful arguments may be deployed in their support. He also aims to locate the crux of the conflict between Wittgenstein's early and late philosophies. This is shown to arise from his earlier commitment to the objectivity of logic and logical relations, which is the true target of attack of his later discussion of (...) rule-following. Within this general framework Dr Carruthers explores a number of themes, including the early Wittgenstein's doctrine of the priority of logic over metaphysics, the nature and purpose of his programme of analysis for ordinary language and the various possible arguments supporting the existence of Simples. He offers many original interpretations and defends them with considerable attention to textual detail, yet the book's clarity and directness will make it accessible to anyone acquainted with the Tractatus. It will be required reading for all serious students of Wittgenstein's philosophy. (shrink)

In this paper, criticisms are made of the main tenets of Professor Mellor's argument against ‘backwards’ causation. He requires a closed causal chain of events if there is to be ‘backwards’ causation, but this condition is a metaphysical assumption which he cannot totally substantiate. Other objections to Mellor's argument concern his probabilistic analysis of causation, and the use to which he puts this analysis. In particular, his use of conditional probability inequality to establish the ‘direction’ of causation is shown to (...) be in error. 1I am indebted to Drs H. Krips, L. Contrary to the conventional wisdom held by many, Dr. Peter Baofu argues that the current popularity of postmodernism in the humanities (especially though not exclusively in relation to the arts) will not last, as it constitutes an aesthetic fad in this day and age of postmodernity. This thesis has important implications for understanding beauty, ugliness, and other aesthetic categories, be the era in the past, present, or future, to the extent that the current theoretical debate on aesthetic experience is (...) as much misleading as obsolete. The current debate also obscures something more tremendous in the long run, in relation to the emergence of what Dr. Baofu originally proposes as the great transformations of aesthetic experience in the coming future that humans have never known, both here on Earth and later in deep space, in accordance to the five theses of his transformative theory of aesthetic experience. While stigmatisation is universal, stigma research in low- and middle-income countries (LMIC) is limited. LMIC stigma research predominantly concerns health-related stigma, primarily regarding HIV/AIDS or mental illness from an adult perspective. While there are commonalities in stigmatisation, there are also contextual differences. The aim of this study in DR Congo (DRC), as a formative part in the development of a common stigma reduction intervention, was to gain insight into the commonalities and differences of stigma drivers (triggers of stigmatisation), facilitators (factors (...) positively or negatively influencing stigmatisation), and manifestations (practices and experiences of stigmatisation) with regard to three populations: unmarried mothers, children formerly associated with armed forces and groups (CAAFAG), and an indigenous population. Group exercises, in which participants reacted to statements and substantiated their reactions, were held with the ‘general population’ (15 exercises, n = 70) and ‘populations experiencing stigma’ (10 exercises, n = 48). Data was transcribed and translated, and coded in Nvivo12. We conducted framework analysis. There were two drivers mentioned across the three populations: perceived danger was the most prominent driver, followed by perceived low value of the population experiencing stigma. There were five shared facilitators, with livelihood and personal benefit the most comparable across the populations. Connection to family or leaders received mixed reactions. If unmarried mothers and CAAFAG were perceived to have taken advice from the general population and changed their stereotyped behaviour this also featured as a facilitator. Stigma manifested itself for the three populations at family, community, leaders and services level, with participation restrictions, differential treatment, anticipated stigma and feelings of scapegoating. Stereotyping was common, with different stereotypes regarding the three populations. Although stigmatisation was persistent, positive interactions between the general population and populations experiencing stigma were shared as well. This study demonstrated utility of a health-related stigma and discrimination framework and a participatory exercise for understanding non-health related stigmatisation. Results are consistent with other studies regarding these populations in other contexts. This study identified commonalities between drivers, facilitators and manifestations—albeit with population-specific factors. Contextual information seems helpful in proposing strategy components for stigma reduction. (shrink)

Cohen On 24 July 1998, Russell Eugene Weston, Jr., stormed the United States Capitol, forced his way through a security checkpoint, bypassed a metal detector, and entered the office complex of Representative (...) Tom DeLay (R-TX), the House Majority Whip (Weil 1998). During this period of terror, he shot and killed two officers of the Capitol Police and seriously wounded another as they attempted to end his foray. 1 Weston was severely wounded by several Capital police officers and taken into custody. After being treated for his injuries, he was incarcerated in the District of Columbia. 2On 5 May 1999, Weston was transferred to the Federal Correctional Institute in Butner, North Carolina (United States v. Weston, 69 F. Supp. 2d 99 (D.D.C. 1999), 103), where he remains to this day. He has neither been brought to trial nor received appropriate psychiatric therapy, but continues to be warehoused "in solitary confinement under constant observation... in a psychotic state (United States v. Weston, 255 F.3d 873; LEXIS 16851 (U.S. App. 2001b), 3-4 [LEXIS]). I will briefly detail the legal events responsible for this mad situation and suggest alternative actions that should have been taken at the very onset of the case. Early Chronology Although overtly the crime appeared to be senseless and without any conceivable motivation, Weston believed that his acts were justified and necessary. The story he told to the court-appointed forensic psychiatrist, Sally C. Johnson, M.D., 3 was that while working for NASA in the early 1980s, he had developed a "Ruby Satellite System," a powerful machine that could reverse time. With access to this system, nothing was permanent--the user could simply reverse time and exit from the current scene. However, the "System" was now controlled by cannibals who were developing and spreading "Black Heva," the deadliest disease known to [End Page 391] humankind, similar to HIV or the plague. It resulted from human corpses rotting and turning black. Time was running out, and Weston believed he had to return to override the "Ruby Satellite System" in the Capitol so that he could stem the spread of "Black Heva" and prevent world calamity. He believed that if he were tried, convicted, and even executed, he could simply time reverse himself, place himself in a safe within the Capitol, and subsequently resume his life at whatever point he chose (United States v. Weston, 206 F.3d 9 (D.C. Cir. 2000), 19-20).On 22 April 1999, the district court accepted Dr. Johnson's diagnosis that Weston suffered from paranoid schizophrenia, the symptoms of which were so severe that he would be incapable of understanding the proceedings against him and of assisting in his own defense. On this basis, the court had no difficulty in finding him incompetent to stand trial (U.S. v. Weston 1999, 102).At Weston's initial hearing, Dr. Johnson had testified that medication would be efficacious in treating Weston's delusions: [T]he standard of care in someone suffering from this type of symptom picture would be to treat them with medication.... [T]here is a good likelihood that he'll have a positive response, positive in the sense that his symptoms will diminish in response to treatment.... The potential benefits to treating the defendant far outweigh the risks.... (U.S. v. Weston 1999, 108) The defense presented no expert testimony refuting Dr. Johnson's presentation. The district court then ordered that Weston begin receiving medication in order to render him nondangerous and competent for trial (U.S. v. Weston 1999, 108-9). The Problem Weston refused to be medicated! 4 He has continued to claim that the administration of antipsychotic drugs against his will would violate his Fifth Amendment due process liberty interest in avoiding unwanted bodily intrusion and implicated... In April 1999, Dr. Curt Freed of the University of Colorado in Denver and Dr. Stanley Fahn of Columbia Presbyterian Center in New York presented the results of a four-year, $5.7 million government-financed study using tissue from aborted fetuses to treat Parkinson’s disease at a conference of the American Academy of Neurology. The results of the first government-financed, placebo-controlled clinical study using fetal tissue showed that the symptoms of some Parkinson’s patients had been relieved. This research study involved forty subjects, (...) nineteen women and twenty-one men; all suffered from Parkinson’s disease for an average of 13.5 years. In the study, each subject underwent neurosurgery: “four tiny burr holes, drilled through the wrinkle lines above the eyebrows into the skull, to clear a pathway to the brain. But only half received injections of fetal cells into the putamen, the region of the brain that controls movement; the other half received nothing. One year later, three members of the placebo group said their symptoms had improved.” In two-thirds of the transplant recipients, the fetal tissue took hold and seemed to establish a new network to produce the missing neurochemical dopamine. This book examines the philosophical foundations of the realist view of the progress of science as cumulative. It is a view that has recently been faced with a number of powerful attacks in which successive scientific theories are seen, not as extending their scope and honing their explanations, but as incommensurable. There is, it is held, in principle no way of establishing that they are about the same things. From the voluminous literature on the topic, Dr Smith has selected relevantly (...) and incisively and his exposition of the contending arguments is vigourous and clear, without undue technicality. As an explication and defence of realism it will interest all those concerned with this basic question in the philosophy of science and the philosophy of language. (shrink)
